  • The Construction Contracts Act 2004 (WA) (CCA) protects the rights of subcontractors to receive payments for goods or services delivered

  • The CCA applies to a contract to perform construction work or provide related goods and services on a construction site in WA

  • The CCA provides for fast adjudication of 'payment disputes' for which either party to the construction contract can apply for adjudication

  • ​An adjudication application may only be made within 90 days after a payment dispute arises.

  • ​Upon filing in accordance with s 43(2) CCA, the Adjudicator’s determination is taken to be an order of the court and may be enforced accordingly.
